Federal Injunction Issued Against Transgender Procedure Ban

Judge says the Arkansas law violates the First Amendment.

District Judge Jay Moody issued a permanent injunction earlier this week against an Arkansas law that sought to ban all healthcare institutions from providing gender transition procedures to people under the age of 18. 

The state of Arkansas passed the law in 2021, becoming the first to ban transgender interventions on minors in the United States. Judge Moody imposed a temporary block on the law that same year, allowing the court time to review the legislation without its provisions being in effect. 

After review, Judge Moody ruled that the law violates healthcare providers’ First Amendment rights by preventing the recommendation of alternative healthcare providers to gender transition youth.

The state of Arkansas plans to appeal Moody’s decision.
